FREEPGS.COM TERMS OF SERVICE
FreePgs has a zero tolerance policy for spam,
pornography, and warez. This Terms of Service Agreement explicitly
states the terms and conditions governing the use of the services, including technology
and content, of FreePgs.com and/or LVCS.net. By opening an account, you (the USER) accept these terms
and conditions and acknowledge that your use of the FreePgs service is subject to
certain limitations set forth below. If you do not accept this agreement, do not
proceed with the sign-up process.
Please ensure contact information is always kept up to date in the event we need to contact you regarding
your account. (i.e. in the event we receive an abuse report regarding your account)
A Violation of any of the below Terms
of Service will result in the suspension and/or termination of your account, with or without warning.
FreePgs.com
is a private service which provides excellent web hosting. FreePgs.com reserves
the right to cancel any account for any reason or no reason at all. FreePgs.com
provides web hosting to any site that abides to our terms and conditions. FreePgs.com
reserves the right to change the terms and conditions at any time. You are entirely
liable for all activities conducted through your account.
The following rules apply while using FreePgs.com services:
Pornographic, obscene,
nude, graphically violent, and other inappropriate content is strictly prohibited. FreePgs.com is not responsible for the content of any member homepages. We reserve
the right to remove any homepages that are in violation of our terms and conditions.
Members will be held legally responsible for the contents of their web pages for,
but not limited to use of copyrighted material without the permission of the author
or posting material considered indecent for minors. The use of FreePgs.com Homepages
for illegal purposes is strictly forbidden and the homepage will be removed without
notice. FreePgs.com membership will be revoked if any of the following
activities occur:
| a) | Adult or Pornographic related |
| b) | Warez or Software Piracy related (including linking to and/or storing illegal files) |
| c) | Music Piracy Related |
| d) | Hacking Related |
| e) | Making available copyrighted software which has been "cracked" (e.g., copyright protection for the software has been removed) |
| f) | Making available serial numbers for software which can be used to illegally validate or register software. |
| g) | Making available tools which can be used for no purpose other than "cracking" software. |
| h) | Any type of spamming or mail bombing (Sending bulk email from scripts) |
| i) | Anything related to illegal activity |
| j) | Accounts containing torrent, emulator(s), and/or emulator ROM files |
| k) | Accounts containing pages used for "phishing" email scams |
We do not allow any type of applications, programs, software, or MP3 files on our server unless you are the
full owner and/or have rights to redistribute the application/file. We do not allow the use of any Proxy or Anonymizer scripts in accounts other than for personal use.
No more than 5 simultaneous connections should be used by such as service and it should be restricted by
username/password or require registration. Using the service as a public filter bypass is not permitted. You and any person who has access to your account must evaluate,
and bear the risk associated with, the accuracy,
completeness or usefulness of any Content. FreePgs.com reserves the right to remove
Content which is deemed in FreePgs.com sole discretion harmful, offensive, or
otherwise in violation of the Rules or any rules or policies FreePgs.com has in
place at the time. You may terminate your Account at any
time for any reason. To cancel your account, use the Contact Form FreePgs.com cannot be held liable for any of its services.
We cannot be held liable for any files that are lost and/or corrupted which may occur from
a system crash or hard disk failure. To the full extent permissible under the
applicable law, FreePgs.com shall not be held liable for any direct, indirect, incidental,
special or consequential damages resulting from the use or inability to use FreePgs.com
services. We have the right to cancel our service at any time with or without prior notification All "Linked" accounts (pertaining to previous members with the enhanced Free account)
are required to have a link back to FreePgs homepage on their website. Users can
upgrade to a paid package that does not have this requirement for a one time fee.
If your account is checked and a link is not found pointing to our page, your account
will be suspended. FTP access is provided for the purposes of uploading content, maintaining content, and downloading
content for backup purposes only. It is not to be used for the distribution of
files. FTP usage for "webcam" purposes is not to exceed uploading once
every 10 seconds.
FreePgs reserves the right to revoke or restrict any FTP
access and/or remove any web site for improper or excessive FTP usage. Accounts exceeding their storage limit or "quota" will be automatically suspended
by the system during nightly processing. If your account was suspended you can use the
Contact Form to request reinstatement. An email is automatically
sent to the email address we have on file for you when this occurs. FreePgs may place limits on the amount of bandwidth, server disk space, and other
system resources used by the USER for various services. Users that cause harm to the system
(either intentional or not) could be subject to additional limitations and/or suspension until the issue is resolved.
Users following the rules do not need to worry about their account being limited in this manner.
If your account is suspended you can always use the Contact Form to request
reinstatement and/or further details regarding the issue. Accounts created with fraudulent credit cards
will automatically be removed upon investigation request from either the credit
card issuer or our credit card processor. These investigations can take anywhere
from hours to more than 30 days. Some transactions are cancelled within the same
day if they match certain criteria, while others are not found to be fraudulent
until the cardmember receives their bill and disputes the charges.
If you wish to close your account and you have created it within the last 30 days,
you are entitled to a refund of your startup fee as long as your account is in
good standing. To get this refund you
must use the Contact Form. You must have paid via credit card
or PayPal transfer to receive a refund.
Due to constant fraud, we are no longer accepting direct credit card payments. We only accept
payments via PayPal and postal mail. PayPal payments must be sent via an instant method (i.e.
funded via your credit/debit card or PayPal balance) for the service to be activated immediately.
eCheck payments will take 3-4 bank business days to clear and post to your account.
Your account could be limited if it is found to be using
excessive connection slots thus imparing other users of the service from accessing their pages.
This includes, but is not limited to, Denial-of-Service (DoS) attacks and improperly constructed
scripts that continually open connections to the server for no reason. (This information is provided
to further explain the reasons for Item 13 above)
We may suspend your account at any time for any reason deemed necessary by our staff.
We will provide account details to law enforcement agencies where necessary
Abuse reports should be sent using the Contact Form,
Abuse Report Form, or emailed to abuse(at)freepgs(dot)com.
Please include the FreePgs URL in question so we can take action on the user account.
These terms can change at anytime without prior notification of any kind
